V prípade neoprávneného použitia obsahu alebo dizajnu webovej stránky sa spoločnosť PALMYRA, spol. s r.o. bude domáhať ochrany svojich práv všetkými dostupnými právnymi prostriedkami, najmä nárokov podľa Autorského zákona na zdržanie sa porušovania, odstránenie následkov porušenia, primerané zadosťučinenie vrátane peňažného, náhradu škody a vydanie bezdôvodného obohatenia, ako aj nárokov z ochrany dizajnu Európskej únie. Neoprávnený zásah do autorského práva môže naplniť aj skutkovú podstatu trestného činu porušovania autorského práva podľa § 283 zákona č. 300/2005 Z. z. Trestný zákon.

In the event of unauthorised use of the content or design of the website, PALMYRA, spol. s r.o. will enforce its rights by all available legal means, in particular claims under the Copyright Act for cessation of the infringement, removal of its consequences, appropriate satisfaction including monetary compensation, compensation for damage and surrender of unjust enrichment, as well as claims arising from the protection of European Union designs. Unauthorised interference with copyright may also constitute the criminal offence of copyright infringement under Section 283 of Slovak Act No. 300/2005 Coll., the Criminal Code.

Konanie, ktorým by iný súťažiteľ napodobňoval webovú stránku, jej dizajn, texty alebo označenia spoločnosti PALMYRA, spol. s r.o. spôsobom spôsobilým vyvolať nebezpečenstvo zámeny, alebo ktorým by využíval povesť jej podniku, výrobkov alebo služieb, môže byť nekalou súťažou podľa § 44 a nasl. Obchodného zákonníka, najmä vyvolávaním nebezpečenstva zámeny (§ 47) alebo parazitovaním na povesti podniku, výrobku alebo služby (§ 48). Spoločnosť PALMYRA, spol. s r.o. je v takom prípade oprávnená uplatniť nároky podľa § 53 Obchodného zákonníka, najmä na zdržanie sa konania, odstránenie závadného stavu, primerané zadosťučinenie, náhradu škody a vydanie bezdôvodného obohatenia.

Conduct by which another competitor imitates the website, its design, texts or designations of PALMYRA, spol. s r.o. in a manner capable of causing a likelihood of confusion, or by which it exploits the reputation of its business, products or services, may constitute unfair competition under Section 44 et seq. of the Slovak Commercial Code, in particular causing a likelihood of confusion (Section 47) or parasitising on the reputation of a business, product or service (Section 48). In such a case, PALMYRA, spol. s r.o. is entitled to assert claims under Section 53 of the Commercial Code, in particular for cessation of the conduct, removal of the unlawful state, appropriate satisfaction, compensation for damage and surrender of unjust enrichment.

Handlungen, durch die ein anderer Mitbewerber die Website, ihr Design, ihre Texte oder die Kennzeichen der PALMYRA, spol. s r.o. in einer Weise nachahmt, die geeignet ist, eine Verwechslungsgefahr hervorzurufen, oder durch die er den Ruf ihres Unternehmens, ihrer Produkte oder Dienstleistungen ausnutzt, können unlauteren Wettbewerb im Sinne von § 44 ff. des slowakischen Handelsgesetzbuchs darstellen, insbesondere die Herbeiführung einer Verwechslungsgefahr (§ 47) oder die Ausbeutung des Rufes eines Unternehmens, eines Produkts oder einer Dienstleistung (§ 48). Die PALMYRA, spol. s r.o. ist in diesem Fall berechtigt, Ansprüche nach § 53 des Handelsgesetzbuchs geltend zu machen, insbesondere auf Unterlassung, Beseitigung des rechtswidrigen Zustands, angemessene Genugtuung, Schadensersatz und Herausgabe der ungerechtfertigten Bereicherung.

Spoločnosť PALMYRA, spol. s r.o. si v súlade s čl. 4 ods. 3 smernice Európskeho parlamentu a Rady (EÚ) 2019/790 a zodpovedajúcimi ustanoveniami Autorského zákona výslovne vyhradzuje právo na vyťažovanie textov a údajov z obsahu webovej stránky. Použitie obsahu webovej stránky na vyťažovanie textov a údajov, na trénovanie, dolaďovanie alebo testovanie systémov umelej inteligencie, ako aj na generovanie obsahu alebo dizajnu, ktorý napodobňuje webovú stránku, je bez predchádzajúceho písomného súhlasu zakázané. Táto výhrada je vyjadrená aj strojovo čítateľným spôsobom v kóde webovej stránky.

In accordance with Article 4(3) of Directive (EU) 2019/790 of the European Parliament and of the Council and the corresponding provisions of the Copyright Act, PALMYRA, spol. s r.o. expressly reserves the right to text and data mining of the content of the website. It is also prohibited to display the website or parts of it within another website (framing), to create links that give the impression that the content belongs to another person, to systematically or massively download or extract the content of the website by automated means (e.g. bots, scraping), except for normal indexing by internet search engines, and to interfere in any way with the security or functionality of the website.

Ich použitie tretími osobami bez predchádzajúceho písomného súhlasu je zakázané. Obchodné mená, ochranné známky a označenia výrobkov tretích osôb, najmä výrobcov technológií, s ktorými spoločnosť PALMYRA, spol. s r.o. spolupracuje, patria ich príslušným vlastníkom a na webovej stránke sú uvedené výlučne na informačné účely.

The business name PALMYRA, spol. s r.o., the designation PALMYRA, the company logo and other designations used on the website are protected as a business name under Sections 8 and 12 of the Slovak Commercial Code and as designations by which PALMYRA, spol. s r.o. distinguishes itself in economic competition. Na ochranu formulárov pred spamom a automatizovaným zneužitím používame službu Cloudflare Turnstile (poskytovateľ Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA). Turnstile pri odoslaní formulára overuje, či ho odosiela človek, a na tento účel krátkodobo spracúva technické údaje ako IP adresa a informácie o prehliadači a zariadení; tieto údaje sa nepoužívajú na reklámu ani na profilovanie. Právnym základom spracúvania je oprávnený záujem prevádzkovateľa (čl. 6 ods. 1 písm. f) GDPR) na ochrane stránky a formulárov pred zneužitím. We do not share personal data with third parties for marketing purposes. Access may be granted to trusted processors that support our operations: the web platform and hosting provider, including contact form processing (Webflow, Inc.), the provider of the content delivery network, anonymous analytics and Turnstile form protection (Cloudflare, Inc.) and our e-mail service provider. All are bound by contract and confidentiality.
